Mahkamah Persekutuan hari ini telah menolak rayuan daripada Mayneu dengan kos memihak kepada NUBE.
Mahkamah memutuskan bahawa Ketua Pengarah Kesatuan Sekerja (KPKS) tidak mempunyai budi bicara mutlak dalam memutuskan samada dia hendak atau tidak mendaftarkan sesuatu kesatuan sekerja. KPKS wajib mempertimbangkan pandangan kesatuan sekerja sudah wujud jika sebuah lagi kesatuan sekerja telah memohon untuk mewakili kategori pekerjay-pekerja yang sama. Pendaftaran sesebuah kesatuan sekerja itu bukan satu proses mekanikal dan KPKS pun tidak boleh bertindak seperti setem getah.
KPKS juga bertanggungjawab untuk mempertimbangkan kesan mendaftarkan kesatuan sekerja tersebut ke atas pekerja-pekerja berkenaan dan industri tersebut secara keseluruhan. KPKS juga perlu ingat kesan mewujudkan pelbagai kesatuan yang mewakili kategori pekerja-pekerja yang sama dan KPKS itu patut mengelakkan kewujudan kepelbagaian kesatuan untuk melindungi keharmonian industri.
