The Federal Court today dismissed the appeal by Mayneu with costs in favour of NUBE.
The Court decided that the Director General of Trade Union (DGTU) does not have absolute discretion in deciding whether or not to register a trade union. The DGTU is obliged to consider the views of an existing trade union if another union had applied to be registered to represent the same category of workmen. The registration of a trade union was not a mechanical process nor was the DGTU to act as a rubber stamp.
The DGTU was also obliged to consider the effect of registering a trade union on the workers concerned and the industry at large. The DGTU was also to bear in mind the effect of having multiple unions representing the same category of workmen and the DGTU was to avoid multiplicity of unions to protect industrial harmony.
